    1.2. This website is owned and operated by Haraka Online with registered offices in Nairobi, Kenya.

    1.3 By using this website, you confirm that you accept these terms and conditions and that you agree to be bound by them. If you do not agree to these terms and conditions, then you may not use this website.

  3. Changes to these terms and conditions
  4. 2.1 We may change these terms and conditions at any time by amending the information on this page.

    2.2 We will inform you if we are intending to make any changes to these terms and conditions, however we advise that you also check back to this page regularly to see if any updates have been made.

    2.3 If you continue to use this website after changes have been made to the terms and conditions then this signifies that you agree to be bound by the updated terms and conditions.

  5. Your obligations and responsibilities
  6. 3.1 By using this website you confirm that you are of at least 18 years of age and that you have the legal capacity to form a contract with us.

    3.2 You agree to pay all of the fees which are applicable to our service and your chosen payment method.

    3.3 You confirm that you are not using these services on behalf of anyone else.

    3.4 You must register with us in order to fully use this website and its services. If you register with the services then you will be asked to provide your email address, a phone number and a password.

    3.5 In order to use the Haraka services then you will be asked to also provide your full legal name, date of birth, address and nationality.

    3.6 You also agree to provide us with any additional information that we may ask of your or your intended receiver such as your address, phone number, nationality and identity documentation as well as a proof of address and source of funds.

    3.7 You warrant that all of the information that has been supplied by you is true and accurate and you confirm that you will update this information on the website if it changes.

    3.8 You will safeguard your account information and ensure that this remains confidential. You will not let anyone else use your account and if you suspect that someone else is using your account information then you must notify us immediately.

    3.9 You may not use this website in any of the following ways:

    - In a way which breaches local law.

    - In a way which is unlawful or fraudulent.

    - For the purpose of harming or attempting
    to harm anyone in any way.

    - To modify any part of the site.

    - You may not attempt to gain unauthorised access to the site.

  7. Our obligations and rights
  8. 4.1 We agree to provide you with access to this website and the services in accordance with these terms and conditions. However, we reserve the right to refuse to provide you with the services without prior explanation.

    4.2 We may update this website or its contents at any time.

    4.3 We are obligated to verify your information in accordance with our Know Your Customer standards before we approve your account. We will use your address and other personal information in order to verify your identity. We may ask for additional ID information in order to carry these checks out.

    4.4 We do not take any responsibility for any damage or loss which you might incur due to your arrangement between you and your receiver. We do not provide any guarantee on the quality, delivery or products that you have paid for using our services and we strongly advise that you only use these services in order to send money to people that you know personally, and not to buy goods or services.

  9. Haraka services
  10. 5.1 In order for us to complete your transaction then you will need to pay for it using your specified payment method. If you do not provide sufficient funds for us to be able to clear the transaction then the transaction will be cancelled.

    5.2 A summary of the details of your transaction will be displayed before you complete the transaction. Please make sure that you check these details carefully and your confirmation will be treated as your consent to initiate the transaction.

    5.3 You agree to pay all fess which are applicable to your chosen payment method and a breakdown of all of these fees will be clearly displayed on the summary of the transaction before you complete it.

    5.4 When you send money abroad and the transferred money will be in a different currency then we will use a currency conversion rate. This rate will be displayed on the site before you complete the transaction. Once you submit your transaction then the currency conversion rate will be locked for a specified time on the website.

    5.5 Once your transaction has been sent then we will send both you and the receiver a confirmation email with all the information about the transaction as well as how to track its progress.

  11. Cancels and refunds
  12. 6.1 You cannot change the details of a transaction once it has been submitted. Please make sure that you read the transaction details carefully before you submit it.

    6.2 If you wish to cancel a transaction, then please contact us as soon as possible but please be aware that we might not be able to do this for you. This will depend on the status of the transaction, and if it has already arrived with the receiver then we will not be able to cancel it for you.

    6.3 If we are able to provide you with a refund and cancel the transaction then we will aim to have the money back to you within seven working days, however, please be aware that we reserve the right to keep any of the fees charged in association with our services. in association with our services.

    6.4 If you believe that you did not authorise a transaction or that a transaction has been incorrectly executed, then please let us know as soon as possible.

  13. Termination and account suspension
  14. 7.1 You may deactivate your account by sending us an email asking us to do this for you, however once you have deactivated your account please be aware that this means that you will no longer be able to log in to it.

    7.2 We reserve the right to suspend your account at any time if we suspect that you have violated any of these terms and conditions.

  15. Disclaimer and Limitation of Liability
  16. 8.1 We do not exclude or limit in any way our liability you where it would be unlawful to do so. This includes liability for death and personal injury caused by our negligence, fraud or fraudulent misrepresentation or for your breach of your legal rights in relation to the services.

    8.2 You understand and agree that under no circumstances shall we be liable for any loss or damage whether this is in contract or in tort or otherwise arising from an inability to use these services.

    8.3 We do not guarantee that the site or any of the content on it will be available or uninterrupted or that the site will be free from bugs or viruses.

    8.4 You expressly agree and understand that your use of this website will be at your sole risk.
